Alternative Dispute Resolution (ADR)

According to the Minnesota Judicial Branchmost family case types filed in district court are subject to ADR processes. Solving your differences outside of court can provide greater satisfaction to the parties. ADR can have many advantages as well, such as:

  • It can save you time.
  • It can save you money.
  • It can be less stressful.
  • It is confidential and private.
  • It gives you more control over the outcome of your case.
  • It can produce more lasting agreements.
  • It may preserve or improve relationships. This is especially important in conflict involving families in which it is critical to preserve the relationship and foster ongoing communication.


Peacetree currently is offering the following ADR services: Evaluative Mediation, Facilitative Mediation, Financial Early Neutral Evaluation (FENE), and Social Early Neutral Evaluation (SENE). These alternative resolution processes on average have an 80% success rate.

Mediation is a formal negotiation. Peacetree mediators are impartial third parties who facilitate conversations and decision-making processes. Peacetree has trained staff that specializes in mediating family issues where maintaining relationships and fairness are important to the participants.

Early Neutral Evaluation (ENE) is a confidential, voluntary, evaluative process designed to facilitate prompt dispute resolution in custody, parenting time (visitation), and financial matters. Peacetree has trained staff available to provide a SENE and/or FENE.

What is the difference between early neutral evaluation and mediation?

In ENE the judge is involved in the early stages as well as in the finalization of the agreement. One primary difference between early neutral evaluation and mediation is that early neutral evaluation takes place completely within the court system and mediation does not.

Evaluative Family Mediation: Peacetree evaluative mediators often work in caucus.

Facilitative Family Mediation: Peacetree facilitative mediators practice facilitating mindful strategic planning.

Financial Early Neutral Evaluation: Peacetree FENE professionals offer an expedited, voluntary, and confidential evaluative processes designed to facilitate prompt dispute resolution of financial issues, such as property, debt, child support, and spousal maintenance.

Social Early Neutral Evaluation: Peacetree SENE professionals focus on the needs of the child(ren) in the relationship. It can address custody, parenting time, and other needs of the child(ren). It could also address other non-financial issues between the parties if there are any.

Service Fees

Melissa Nikovics – $245/hour

Payment for mediation service is due before your session begins.  Please pay online at least 24 hours before your session begins. Failure to do so, will result in the cancellation of your appointment. Payments for mediation services are based off of a four-hour time block.

SENE and FENE service fees are set by the county in which the petition was filed. A custom invoice will be sent to your email.
